1. Overview & Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "you") and FLIQAINDIA PRIVATE LIMITED ("Company", "we", "our", or "us"), governing your access to and use of the Fliqa Sharing website, application, APIs, and associated digital services located at https://sharing.fliqaindia.com.
By creating an account, uploading files, generating share links, or completing a paid plan checkout, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our service.
2. Description of Digital Service
Fliqa Sharing is a cloud-based software-as-a-service (SaaS) platform designed for photographers, creators, creative studios, and businesses to upload, organize, store, preview, deliver, and collect digital media assets (including high-resolution photos, 4K videos, documents, and archives).
The service operates purely as a digital cloud solution. No physical goods or physical media storage devices are sold or delivered.
3. User Accounts, Security & Credentials
- You must provide accurate, current, and complete registration information.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You must immediately notify us at support@fliqaindia.com if you suspect any unauthorized access or security breach.
- We reserve the right to suspend or terminate accounts that use disposable emails for malicious activity or impersonation.
4. Content Ownership, Intellectual Property & Acceptable Use
Your Content Remains Yours: You retain complete ownership, copyright, and intellectual property rights in all files, media, and data you upload to Fliqa Sharing. We do not claim any ownership over your content.
License to Host: You grant FLIQAINDIA PRIVATE LIMITED a limited, worldwide license solely to host, store, transfer, generate preview thumbnails for, and deliver your content as instructed by you through share links and folder permissions.
Prohibited Activities: You strictly agree not to upload, transmit, or share any content that:
- Infringes on third-party copyrights, trademarks, or proprietary rights.
- Contains malicious software, viruses, ransomware, or harmful scripts.
- Is unlawful, defamatory, abusive, sexually explicit involving minors, or violating Indian cyber laws (Information Technology Act, 2000).
- Attempts to bypass server storage quotas, scrape share links, or overload service infrastructure.
5. Storage Limits, 30-Day Subscription Lifecycle & Deletion Policy
50 GB Free Tier: Free accounts receive 50 GB of active storage capacity. New uploads on the Free plan remain active and publicly shareable for 7 days. On day 7, links expire and a 3-day recovery window begins, allowing the owner to download or restore files before permanent removal.
Paid Plans (30-Day Lifecycle): Paid tiers (Starter 100 GB, Creator 500 GB, Studio 1 TB, Business 5 TB, Enterprise 10 TB) operate on a fixed 30-day subscription cycle with password-protected links, custom expiration, and priority delivery.
Day 30 Storage Cleanup Policy: Unrenewed paid subscriptions do not retain customer storage beyond the 30-day paid period. Renewal reminders commence on Day 23 (Days 23, 25, 27, 29, 30). If renewal is not completed by Day 30, customer storage is permanently removed and deleted from Cloudflare R2 storage without an extended grace period.
6. Pricing, Taxes & Billing Model
Base Prices & GST: All displayed plan prices (Starter: ₹149, Creator: ₹749, Studio: ₹1,499, Business: ₹7,990, Enterprise: ₹14,990) are exclusive of applicable 18% Goods & Services Tax (GST). Total payable amounts are itemized before checkout (e.g., Starter: ₹149 + ₹26.82 GST = ₹175.82 total).
30-Day Prepaid & Auto-Renewal: Paid plans grant service access for a 30-day billing cycle. Customers can opt into automatic renewal or renew manually through Razorpay. Standing authorizations are strictly customer-controlled and can be canceled anytime from Account Settings.
Instant Digital Delivery: Upgraded storage quotas and features activate immediately in your account upon successful cryptographic verification of the transaction.
7. Cancellation & Refund Policy
Our complete cancellation and refund provisions are detailed in our dedicated Refund & Cancellation Policy. In summary:
- You may cancel at any time by choosing not to renew at the conclusion of your 30-day prepaid service period.
- Duplicate charges or verified technical activation failures will be 100% refunded.
- Approved refunds are credited back to your original payment instrument via Razorpay within 5 to 7 business days.
8. Limitation of Liability & Disclaimers
To the maximum extent permitted by applicable law, FLIQAINDIA PRIVATE LIMITED provides Fliqa Sharing on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not warrant that service will be uninterrupted or error-free. You are advised to maintain independent backups of business-critical assets.
In no event shall FLIQAINDIA PRIVATE LIMITED be liable for any indirect, incidental, or consequential damages arising from service usage or loss of data, exceeding the total amount paid by you in the preceding 30 days.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute or claim arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal, India.
